When you cease to be a Canadian tax resident, the CRA deems you to have sold most of your property at fair market value on your departure date. Capital gains that accrued while you were a resident become taxable immediately — this is the "deemed disposition." Your principal residence, RRSPs, RRIFs, and TFSAs are generally exempt; non-registered investments, rental real estate, and business interests are not. ### What is a Section 216 election? A non-resident who owns Canadian rental property can elect under Section 216 to file a Canadian return and pay tax on net rental income rather than the default 25% withholding on gross rent. This usually lowers the tax owed and can produce a refund of over-withheld amounts. ### What is a Section 217 election? A non-resident receiving Canadian pension or benefit income (CPP, OAS, RRSP/RRIF withdrawals) can elect under Section 217 to be taxed at graduated rates instead of the flat 25% withholding.
